This Privacy Policy applies exclusively to the use of our website at k-restructuring.law. A separate data protection notice applies to the processing of personal data in the context of attorney-client mandate relationships; this notice will be provided to you upon mandate initiation.

The appointment of a data protection officer is not required pursuant to Article 37 GDPR in conjunction with Section 38(1) BDSG, as fewer than 20 persons are regularly engaged in the automated processing of personal data and the further requirements of Article 37(1) GDPR are not met.

You may exercise the following rights at any time by contacting us using the details set out above:

Right of access (Article 15 GDPR)

You have the right to request information from us as to whether and which personal data we process about you, the purposes for which the processing is carried out, to whom the data is transmitted, and how long it is stored.

Right to rectification (Article 16 GDPR)

You have the right to request the rectification of inaccurate personal data or the completion of incomplete personal data.

Right to erasure (Article 17 GDPR)

You have the right to request the erasure of your personal data, provided that no statutory retention obligations or overriding legitimate interests preclude such erasure.

Withdrawal of consent (Article 7(3) GDPR)

Where you have given us your consent, you may withdraw it at any time with effect for the future. The lawfulness of any processing carried out on the basis of the consent prior to its withdrawal remains unaffected.

3. Hosting

Our website is hosted by netcup GmbH, Emmy-Noether-Straße 10, 76131 Karlsruhe, Germany. When you access our website, netcup, acting as our processor, automatically collects information in so-called server log files which your browser transmits automatically.

We have concluded a data processing agreement (Auftragsverarbeitungsvertrag) with netcup pursuant to Article 28 GDPR, which ensures that netcup processes the data of our website visitors solely in accordance with our instructions and in compliance with the requirements of the GDPR.

The legal basis for the use of hosting services is Article 6(1)(f) GDPR (legitimate interest in a reliable and secure provision of our website).

4. Collection of general information when visiting our website

When you access our website, no systematic server access log files containing IP addresses are written at the application level. The IP address is processed solely on a transient basis for the purpose of delivering the requested content and is not stored persistently. In the event of technical malfunctions, individual IP addresses may briefly appear in the diagnostic logs of the reverse proxy; such entries are used exclusively for error correction and are lost at the latest upon the next deployment of the application.

At the infrastructure level, our hosting provider (netcup GmbH) collects its own technical log data, which is erased after 14 days. The legal basis is Article 6(1)(f) GDPR (legitimate interest in the stability and security of the website).

5. Cookies

This website does not use cookies. No tracking, analytics or other cookies are set. No tracking of your user behaviour takes place.

6. Contact Form

Our website does not currently offer an active contact form. The introduction of a contact form is in preparation. As soon as it is available, we will amend this Privacy Policy accordingly and inform you of the nature, scope and purpose of the personal data collected in this connection.

At present, you can only contact us by email or telephone (see Section 7).

7. Contact by Email

Where you contact us by email, the data you provide (your email address and, where applicable, your name, your telephone number and the content of your message including any attachments) is stored by us in order to respond to your enquiry.

For the receipt and dispatch of our emails, we use the Microsoft 365 (Exchange Online) service provided by Microsoft Ireland Operations Ltd., One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. We have concluded a data processing agreement with Microsoft pursuant to Article 28 GDPR (Microsoft Products and Services Data Protection Addendum). Processing may also be carried out by Microsoft Corporation (Redmond, USA) as a sub-processor. Microsoft is certified under the EU-US Data Privacy Framework; in addition, the Standard Contractual Clauses pursuant to Article 46(2)(c) GDPR as well as supplementary technical and organisational measures apply.

For the dispatch of certain emails, we additionally use a service provided by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, with which a data processing agreement pursuant to Article 28 GDPR has likewise been concluded.

We would point out that the transmission of emails via the internet may generally take place in unencrypted form and cannot be regarded as completely secure. Please do not transmit confidential or sensitive information by unencrypted email. For encrypted communication, please contact us by telephone in advance.

Legal basis: Article 6(1)(f) GDPR (legitimate interest in electronic accessibility). Where the email contact is aimed at the conclusion of a contract, the additional legal basis is Article 6(1)(b) GDPR.

We erase the data collected in this connection once storage is no longer necessary, or restrict the processing where statutory retention obligations apply. Where a mandate relationship arises from the communication, our separate data protection notice on mandate processing applies to any further processing.

8. Disclosure to Third Parties

Your personal data is not disclosed to third parties — apart from the processors expressly named in this Privacy Policy (netcup GmbH, Ionos, Microsoft Ireland Operations Ltd.) — unless we are legally obliged to do so or you have expressly consented.

9. Locally Embedded Fonts

Our website uses fonts (Crimson Pro, Open Sans). These fonts are stored locally on our server and are loaded from there. No connection to external servers (e.g. Google Fonts) is established. No personal data is transmitted to third parties in this connection.

10. SSL/TLS Encryption

In order to protect the security of your data during transmission, we use encryption methods (TLS) via HTTPS which correspond to the current state of the art.

11. External Links

Our website contains links to third-party websites. If you click on such a link, you will be redirected to the external website. We have no influence over the content or the data processing of these external offerings. The respective privacy policies of the providers concerned shall apply. In particular, your IP address may be transmitted to the respective provider when you click on external links.

12. Information regarding your right to object pursuant to Article 21 GDPR

Right to object on grounds relating to your particular situation:

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Article 6(1)(f) GDPR (data processing on the basis of a balancing of interests); this also applies to profiling based on that provision within the meaning of Article 4(4) GDPR.

If you lodge an objection, we shall no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

We reserve the right to amend this Privacy Policy to ensure that it complies at all times with current legal requirements, or in order to implement changes to our services in the Privacy Policy, for example upon the introduction of new services. The amended Privacy Policy shall apply to any subsequent visit.
